Certain products sold by Meduvon may require special shipping, freight delivery, additional handling, installation, assembly, or delivery arrangements.

Examples may include large medical equipment, hyperbaric chambers, oxygen equipment, mobility equipment, industrial equipment, and other specialty products.

Additional shipping charges or delivery requirements may apply.

Customers purchasing large or specialty equipment are responsible for ensuring that the delivery location is suitable for receiving the product, including appropriate access, doorway clearance, loading arrangements, flooring, electrical requirements, ventilation, or other manufacturer-specified requirements where applicable.

Unless expressly stated otherwise, Meduvon does not provide structural modifications, construction, electrical installation, plumbing, medical supervision, or professional installation services.

14. TITLE AND RISK OF LOSS

Unless otherwise required by applicable law, title and risk of loss for products purchased from Meduvon pass in accordance with the applicable shipping and delivery terms.

Once an order has been transferred to the applicable shipping carrier, delays, loss, damage, or other transportation issues may be subject to the carrier's procedures and applicable shipping protections.

Customers should inspect packages promptly upon delivery and report visible shipping damage to Meduvon and the carrier as soon as reasonably possible.

15. USER ACCOUNTS

Certain Services may allow or require you to create an account.

You are responsible for:

19. SHOPIFY

Meduvon uses Shopify as its ecommerce platform.

Shopify provides the technology and infrastructure that helps us operate our online store. However, purchases made through Meduvon are transactions between the customer and Meduvon.

Shopify is not the seller of the products purchased from Meduvon and is not responsible for the products, fulfillment, warranties, returns, refunds, or customer-service obligations associated with your transaction with Meduvon.

20. PROHIBITED USES

You may not use the Services:

  2. To violate applicable laws or regulations;

  3. To infringe intellectual-property rights;

MEDUVON DOES NOT WARRANT THAT:

  • THE WEBSITE WILL ALWAYS BE AVAILABLE;

  • THE WEBSITE WILL BE ERROR-FREE;

  • INFORMATION WILL ALWAYS BE ACCURATE OR COMPLETE;

  • PRODUCTS WILL ALWAYS BE AVAILABLE;

  • DELIVERY WILL OCCUR WITHIN A PARTICULAR TIMEFRAME; OR

  • THE SERVICES WILL MEET EVERY CUSTOMER'S PARTICULAR REQUIREMENTS.

Nothing in these Terms excludes or limits any warranty, right, or protection that cannot legally be excluded or limited under applicable law.

23. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDUVON AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PURCHASE OR USE OF PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEDUVON'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO MEDUVON FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

This limitation does not apply to liability that cannot legally be limited or excluded under applicable law.

24. PRODUCT USE AND CUSTOMER RESPONSIBILITY

Customers are responsible for using products in accordance with applicable instructions, warnings, operating requirements, manufacturer documentation, and applicable laws.

Meduvon is not responsible for damage, injury, loss, or malfunction resulting from misuse, improper installation, unauthorized modification, improper maintenance, failure to follow instructions, improper storage, unauthorized repairs, or use outside the manufacturer's specified conditions.

For medical, scientific, laboratory, industrial, or technical equipment, customers are responsible for ensuring that operators have the appropriate knowledge, training, qualifications, licenses, or certifications required for the intended use.

25. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Meduvon and its owners, affiliates, officers, directors, employees, agents, contractors, suppliers, service providers, and licensors from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from or related to:

  1. Your violation of these Terms;

  2. Your violation of applicable law;

  3. Your misuse of the Services;

  4. Your misuse of a product;

  5. Your violation of the rights of another person; or

  6. Information or User Content that you submit to Meduvon.

This provision applies to the extent permitted by applicable law.

26. TERMINATION

We may suspend or terminate your access to the Services if you violate these Terms, engage in fraudulent or unlawful activity, interfere with the operation of the website, or otherwise create a legal, security, or operational risk.

Termination does not eliminate obligations that arose before termination.

Provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and other provisions that by their nature should survive termination will remain effective.

27. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

29. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and other policies expressly incorporated into these Terms, constitute the agreement between you and Meduvon regarding your use of the Services.

These Terms replace prior versions of the Terms of Service relating to the Services, except where otherwise expressly stated.

30. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Meduvon may assign or transfer its rights and obligations under these Terms as permitted by applicable law.

31. GOVERNING LAW

These Terms will be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent that applicable federal or state law requires otherwise.

Any dispute that is not otherwise resolved between you and Meduvon will be subject to the jurisdiction of courts located in the applicable jurisdiction in Texas, subject to any mandatory consumer-protection or other applicable legal requirements.

32. CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we make changes, we will post the updated Terms on this page and update the "Last Updated" date.

Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
